The U.S. Department of Education is now going to investigate hundreds of disability-related complaints. Just before Thanksgiving the department rescinded a provision adopted in March that allowed the Office of Civil Rights to dismiss any complaint that was part of a pattern of complaints by the same person or group that placed a burden on OCR’s available resources. This provision also eliminated the appeals process for complaints. As a result of this provision hundreds of complaints were dismissed but now will be investigated. The change comes because of a lawsuit filed by three groups that included the National Federation of the Blind (NFB), the Council of Parent Attorneys and Advocates (COPAA), and the National Association for the Advancement of Colored People (NAACP).
